Waiver & Indemnity Waiver & Indemnity * PARTICIPATION AGREEMENT, INDEMNITY AND WAIVER (IMPORTANT NOTICE: THIS DOCUMENT SHOULD BE CONSIDERED CAREFULLY, BY SIGNING IT, YOU ARE GIVING UP YOUR AND/OR YOUR MINOR CHILD'S LEGAL RIGHTS IN RESPECT OF PARTICIPATION IN THE ACTIVITIES REFERRED TO BELOW)For purposes hereof, InWine Sports Center, shall mean Helu Park (Pty) Ltd and Das Buro cc which includes its subsidiary(ies), affiliate(s), shareholders, owners, directors, officers, agents, principals, employees, volunteers, participants, clients, customers, invitees, independent contractors, insurers, facility operators, the owner of the property and premises, and any and all other persons and entities acting in any capacity on behalf of InWine Sports Center. In order to be allowed to participate in the services and activities, including, but not limited to all activities and attractions provided by InWine Sports Center, I, on behalf of myself, and/or on behalf of my minor child(ren)/ward(s) in my capacity as parent or guardian, hereby agree to forever release, waive, indemnify and discharge InWine Sports Center on behalf of myself, my spouse, my legal partner, my children, my parents, my guardians, heirs, assigns, personal representatives and estate, and all other persons and entities who could in any way represent me or act on my behalf as follows:(1) WAIVER OF LIABILITY: Despite all known and unknown risks, I hereby expressly and voluntarily waive, acquit and forever discharge InWine Sports Center and agree to hold InWine Hockey harmless against any claims, and all manner of action or actions or omission(s), cause or cause of action in law arising out of any damage, loss, personal injury, or death to me or my child(ren)/ward(s), while participating in or as a result of allowing me, my child(ren)/ward(s) to participate in any of the ACTIVITIES. This Waiver of Liability is effective and valid regardless of whether the damage, loss or death is a result of any act or omission on the part of InWine Sports Center.(2) INDEMNIFICATION: I hereby indemnify and hold harmless InWine Sports Center from and against any and all losses, liabilities, claims, obligations, costs, damages and/or expenses whatsoever paid or to be paid or incurred or suffered by InWine Sports Center, including, but not limited to, any and all attorneys' fees, costs and damages and/or judgments InWine Sports Center incurs in the event that I or my minor child(ren)/ward(s) cause any damage or harm to InWine Sports Center or any and all other persons and entities acting in any capacity on behalf of InWine Sports Center.(3) ATTORNEYS' FEES: I undertake to indemnify InWine Sports Center against any attorneys' fees and/or costs incurred to enforce this agreement, including all costs associated with any collection efforts. Further, should any debt and/or judgment accrue in favour of InWine Sports Center, pre-judgment and post-judgment interest shall accrue at a rate of 18% per annum.(4) USE OF PHOTOS: By entering the InWine Sports Center area and participating in the ACTIVITIES, I hereby grant InWine Sports Center on behalf of myself and on behalf of my child(ren)/ward(s), the irrevocable right and permission to photograph and/or record me or my child(ren)/ward(s) in connection with the InWine Sports Center ACTIVITIES and the use of such photograph and recording for advertising and promotional purposes, in any manner and all media now and thereafter known, in perpetuity throughout the world, without restriction as to alteration. I waive the right to inspect or approve the use of the photograph and/or recording, and acknowledge and agree that the rights granted to this release are without compensation of any kind.(5) DURATION OF AGREEMENT: I understand that this agreement extends forever into the future and will have full force and legal effect each and every time I or my child(ren)/ward(s) visit InWine Sports Center, whether at the current location or any other location or facility.(6) GOVERNING LAW: I agree that this agreement shall be governed by the laws of Republic of South Africa and I hereby submit to the exclusive jurisdiction of the courts of Cape Town with respect to all matters relating to this agreement.(7) SEVERABLE: The terms and conditions of this agreement are severable and should any portion of this agreement be regarded as invalid, such portion or section will not affect the validity of the balance of the agreement.I understand that this document will be signed by me typing my name onto this form and thereafter submitting this document to InWine Sports Center digitally.By signing this document as aforesaid, I understand that I may be found by a court of law to have forever waived my and my child(ren)/ward(s) rights to maintain any action against InWine Sports Center on the basis of any claim from which I have indemnified InWine Sports Center.I confirm that I had a reasonable and sufficient opportunity to read and understand this entire document and consult with legal counsel, or have voluntarily waived my right to do so.I therefore knowingly and voluntarily agree to be bound by the terms and conditions set forth herein. InWine Sports Center reserves the right to request any form of identification in order to verify identity and age. By completing this Form you are electronically certifying this waiver document just as if you would physically sign it if it was on paper.
